Delivery Information

Delivery is available to the UK mainland and is dispatched at our discretion. We will ship your goods by the most appropriate method either via Royal mail special delivery or via courier service. If your order is less than that specified free delivery we will provide shipping costs at the time the order is placed. Most goods are available from stock and will be dispatched for delivered next working day, however this may vary due to third party couriers and stock availability. If we anticipate or are informed of a delay by a third party, we will inform you as soon as possible.

Returns Policy

In order for us to process a return you must obtain a return authority number. This will help us to deal with the matter promptly. We do not accept a return on any items without a return authority number, it is your responsibility to obtain this from us.

No Fault Returns:

Due to the nature of some of our products (coffee and consumables-based products) we cannot accept returns unless the goods are unused and 'as new' in their original boxes/bags and packaging. Spare parts and technical equipment will not be accepted if they have been installed or fitted to any device or machine, they must have no marks on them or have been used or installed in anyway. You must notify us within 3 days from date of delivery, it will be your responsibility to return the goods to us at your own cost and risk via an insured traceable method. Goods received back will be inspected before a credit is issued any missing or damaged products, items, part or incomplete orders returned will be charged to you and the cost taken from you credit note. Goods received back in any condition other than 'as new' may be returned to you with you paying all return charges. We cannot offer any refund of carriage costs
Please note. some items may incur a restocking fee of 10% of the goods valve plus V.A.T if applicable.

Damaged Returns:

A product is deemed to be damaged if it shows signs of damage on delivery you must make a note on the courier or delivery service providers delivery consignment note and keep all packaging, you must contact us within 3 days of delivery. We will ask you to provide photographic evidence of the damaged item or items and packaging this will enable us to bring the matter to the attention of the courier or delivery service provider.  Once the photographic evidence has been assessed and agreed a replacement will be dispatched and the damaged items collection will be arranged.

Faulty items or parts returns

An item or part is deemed to be faulty if it shows signs of malfunction, you must contact us within seven days of the deliver date, we will ask you to provide photographic evidence if applicable and a description of the fault this will enable us to process the matter and arrange a return (please note all items must be in there original packaging), once the item or part has been received back and assessed we will notify you of the outcome if the item is tested and found to be in good working order it will be returned and carriage may be charged, if the item or part is found to be faulty then a preplacement will be dispatched as soon as possible.

The following terms and conditions apply to all transactions on this website. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.
 
1. Interpretation
In these Terms and Conditions (Terms), the following words and phrases shall have the following meanings:
"The Buyer" means the person, firm or company who purchases the Goods from the Company:
included in this term also includes "Consumer” means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession; "trader” means a person acting for purposes relating to that person’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf.
The "Company" means guzel coffee ltd.
"Contract" means the contract between the Company and the Buyer/Consumer/Trader which shall be deemed to incorporate these Terms;
"Goods" means any goods agreed in the contract to be supplied by the Company to the Buyer/
Consumer/Trader. Contract is, In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time-to-time.

2. The Contract
The Contract shall be on these terms to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the Buyer.
No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract.

3. Delivery and availability
Any dates specified by the Company for delivery of the Goods are intended to be an estimate only. If no date is specified for delivery of the Goods, delivery shall be within a reasonable time.

All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

4. Time Limitation for Notification of Claims
Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 3 days from delivery. You must keep all original packaging and this must be made available for the carrier’s representative to inspect. We will abide by the carriers decision.

Shortages: It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us in writing within 3 days from delivery. 
Incorrect Goods: It is your responsibility to notify us in writing of any incorrect goods supplied within 3 days from delivery.
Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct or consequential, economic or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the Goods.

5. Risk in and Ownership of the Goods
Risk in the Goods shall pass to the Buyer on delivery
Ownership in the Goods shall not pass to the Buyer until the Company has received in full in cleared funds all sums due to the Company in respect of the Goods and all other sums which are or may become due to the Company from the Buyer on any account.

Until ownership of the Goods has passed to the Buyer, the Buyer shall:
Hold the Goods on a fiduciary basis as the Company's bailee;
Store the Goods separately from all other goods of the Buyer or any third party in such a way that they remain identifiable as the Company's property;
Not destroy or deface any identifying mark on the Goods or their packaging;
Maintain the Goods in satisfactory condition insured with the Company's interest noted on the policy and hold any proceeds of such insurance on trust for the Company and not mix them with any other money.

6. Payment and price
Payment in full is required prior to dispatch & delivery of the goods. We accept most major Credit Card and Debit Card payments via SagePay our payments system.

We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the amended price and give you the opportunity to cancel the order. All prices on our website are EXCLUSIVE of VAT and delivery charges. You are responsible for all duties and taxes imposed by your country and any other charges imposed on route via the carrier or any government body. 

7. Warranties
The Company warrants that the goods are of satisfactory quality on the following basis. 

In accordance with the current selling regulations, you are entitled to cancel your order on applicable items at any time within 14 days of receiving your goods. The cancellation period ends on the expiry of the period of 14 working days beginning with the day after the day on which you received the goods. If you wish to cancel an order under these terms, first contact us and then return your products unopened & unused within 14 days of receiving your parcel. The Company's liability under the warranty shall be limited to repairing or replacing the goods in question or refunding the price of such goods, this is at the discretion of the company. If the product returned was on free delivery we will deduct the cost equivalent to the outward delivery cost for that item. This will be subtracted from the total to be refunded. The cost of the return and any duty or taxes is payable buy the buyer. Unwanted returnable items should be returned at the buyers cost in as new condition to qualify for a refund and are subject to the above terms.

8. Limitation of Liability
The Company's liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed the value of the Goods purchased and the Company shall under no circumstances be liable to the Buyer for any consequential, indirect or economic loss or damages.

9. Force Majeure
If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party's obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.

10. General
These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery within the UK. We reserve the right to decline orders for bulk or high value purchases We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms which will otherwise remain in full force and effect.

These Terms shall be governed by and interpreted according to English Law and the parties submit to the exclusive jurisdiction of the English Courts.
